Definitions
This page lists specific definitions for words used in the standard.
Agency
A public service agency as defined in section 10(a) of the Public Service Act (departments, departmental agencies, interdepartmental executive boards and interdepartmental ventures), and/or an entity in the State services adopting as guidance.

Agreement
This refers to any form of legally-binding agreement with a non-government third party, e.g. contract, deed or information sharing agreement.
Collection, access, storage, use, disclosure, retention, disposal
As defined in section 22 of the Privacy Act .
Privacy Act — New Zealand Legislation
Deed
A legal document that contains a binding promise or commitment, which be used to turn an existing arrangement into a legally binding agreement or create a legally binding agreement when there is no ‘consideration’ (payment or benefit).
Delivery of public services
The actions related to designing, providing, improving and measuring public goods, services in the public interest, and services delivered by (or on behalf of) central government for the benefit of New Zealanders.
The boundaries of what are public services are not hard and fast, with different boundaries applying in different locations at different times.
Information sharing agreement
An agreement between a public service agency and a non-government third party that sets out the provisions both parties agree to before the non-government third party receives personal information from an agency, or is authorised to collect personal information on behalf of the public service agency.
Māori Data
As defined in Tuia te Korowai o Hine-Raraunga – Māori Data Governance Model report, Māori data refers broadly to data, information or knowledge (including mātauranga Māori) that is about, from or connected to Māori. It also includes data about population, place, culture and environment.
In the context of this standard this includes personal information about individuals.

Non-government third party (third party)
Any organisation or individual outside the public service (as defined in “Agency”), and State services as defined in section 5 of the Public Service Act , and including entities listed in the sub-section (e) of the definition of State services, except:
- subsections (e)(v) organisations listed in Schedule 1 of the State-Owned Enterprises Act ; and
- (e)(vi) tertiary education institutions.

Notifiable privacy breach
As defined in section 112 of the Privacy Act .

Personal information
As defined in section 7 of the Privacy Act and in Codes of Practice issued under section 33 of the Privacy Act .
For the avoidance of doubt this includes all metadata relating to personal information.
Noting that the Privacy Act says “information about an identifiable individual”.

Privacy breach
As defined in section 112 of the Privacy Act .

Relationship
A recognised connection or association between two or more entities in which each has a set of rights and responsibilities.
Risk assessment
An agency process or tool for determining the level of risk involved in a specific information sharing approach, taking into account their operating context and controls available, the information proposed for sharing, and the parties involved.
Schedule
A document (e.g. inventory, list or documented process) appended to an agreement that outlines specific details related to executing an agreement, which can be updated by mutual agreement as circumstances change.
Sharing
The action of a public service agency providing digital and/or physical access to information and providing the secure transfer of personal information to a non-government third party.
